Case against an individual, public body, or sole trader

Use this letter where you are owed money by a private individual, a public body, or a sole trader. The letter is intended to combine a formal letter before action and an invitation to mediate. With this in mind, it has been drafted to comply with the Pre-Action Protocol for Debt Recovery.

If the other party doesn’t accept the offer of mediation or arrange to pay the debt in full, you should seek independent legal advice to ensure that you comply fully with the Pre-Action Protocol.

Use this letter where you are owed money by a limited company or a partnership. The letter is intended to combine a formal letter before action and an invitation to mediate.

If the other party doesn’t accept the offer of mediation or arrange to pay the debt in full, you should seek independent legal advice to ensure that you comply fully with the requirements needed for formal court proceedings.
